Terms of Service
These Terms are a binding agreement between you and Guess What Country, operated from Los Angeles, California. They cover how you may use the site, what we promise, what we do not, and how disputes are resolved. Please read sections 11 and 12 carefully — they limit your legal remedies and require individual arbitration.

1. Acceptance of these Terms
By accessing guesswhatcountry.com, playing the quiz, or signing in to the team portal, you agree to these Terms and to our Privacy Policy, Cookie Policy and Disclaimers, which are incorporated by reference. If you do not agree, do not use the site. You must be at least 13 years old to use the site and at least 18 to hold a team account. If you accept on behalf of an organization, you represent that you are authorized to bind it.
2. Who we are
The site is operated by Guess What Country, an independent content project based in Los Angeles, California, United States, publishing the YouTube channel @tuchavin. Notices to us may be sent to hello@guesswhatcountry.com; legal and privacy notices to privacy@guesswhatcountry.com.
3. Permitted and prohibited use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the site for your own non-commercial use. You agree not to: scrape, crawl, mirror or bulk-download the site or its data except as permitted by our robots.txt; resell or redistribute our content; bypass or attempt to bypass authentication, roles, rate limits or any security control; probe, scan, overload or disrupt the site or its infrastructure; reverse engineer the site except to the extent that restriction is unenforceable; impersonate any person or misstate your affiliation; upload malicious code; harvest personal information about other users; or use the site in violation of any applicable federal, California or local law, including the Computer Fraud and Abuse Act and Cal. Penal Code § 502.
4. Accounts, roles and suspension
Admin, editor and viewer accounts are created by invitation only. You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. Notify us immediately at privacy@guesswhatcountry.com if you suspect unauthorized access. We may suspend, restrict, downgrade or terminate an account at any time, with or without notice, for a breach of these Terms, a security concern, prolonged inactivity, or at the channel owner's direction. Security-relevant account activity is logged as described in the Privacy Policy.
5. Intellectual property
The videos, episode copy, country guides, artwork, globe visualization, compilation of data and the site's code are owned by Guess What Country or licensed to it and are protected by United States and international copyright, trademark and other laws. You may quote short excerpts for commentary, news reporting, teaching or criticism with clear attribution and a link. Any other reproduction, distribution, adaptation or public display requires our prior written permission. Third-party marks — including YouTube, Google, Instagram, Meta and TikTok — belong to their owners; we are not affiliated with, sponsored by or endorsed by them. Country outlines and map data derive from open datasets and are illustrative only, as explained in our Disclaimers.
6. Feedback and content you submit
If you send us feedback, corrections, guesses or other material, you grant us a non-exclusive, worldwide, royalty-free, perpetual, sublicensable license to use, reproduce, modify and display it to operate and improve the site and the channel, without compensation or attribution. You represent that you own or control the rights to what you send. Do not send confidential information or anything you are not free to share.
7. Copyright complaints (DMCA)
We respect copyright and respond to valid notices under the Digital Millennium Copyright Act, 17 U.S.C. § 512. Send notices to privacy@guesswhatcountry.com with the subject “DMCA notice”, including: your physical or electronic signature; identification of the copyrighted work; the URL of the material you say infringes; your contact details; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner. We will remove or disable access to material that is the subject of a valid notice, notify the poster, and accept counter-notices containing the elements required by § 512(g). Repeat infringers lose access. Knowingly false notices carry liability under § 512(f).
8. AI-assisted features
Clues, SEO suggestions, social snippets, posting-time recommendations, algorithm summaries and analyst commentary are produced by automated systems. They are suggestions, not professional advice, and can be inaccurate, outdated or fabricated — including any cited source. Every AI output in the admin portal passes a human review step before it can be applied, and you are responsible for what you publish after approving it.
9. Availability and changes to the service
The site is provided on an “as is” and “as available” basis. We may add, change, suspend or discontinue any feature, and impose limits, at any time without liability. We do not warrant uninterrupted, secure or error-free operation, or that defects will be corrected.
10. Third-party services and links
The site links to and embeds YouTube and other third-party services. We do not control them and are not responsible for their content, advertising, availability, security or data practices. Your use of those services is governed by their own terms and privacy policies.
11. Disclaimer of warranties and limitation of liability
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from course of dealing or usage of trade.
To the fullest extent permitted by law, Guess What Country and its owner, contributors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to the site, even if advised of the possibility. Our total aggregate liability for all claims relating to the site will not exceed one hundred United States dollars (US$100.00) or the amount you paid us in the twelve months before the claim, whichever is greater. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you; nothing here limits liability that cannot lawfully be limited, including for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence.
You knowingly waive Cal. Civ. Code § 1542, which reads: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
12. Governing law, arbitration and venue
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods.
Informal resolution first. Before filing anything, email privacy@guesswhatcountry.com describing the dispute; we will try in good faith to resolve it within 30 days.
Binding individual arbitration. If we cannot resolve it, any dispute will be settled by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules, before one arbitrator, seated in Los Angeles County, California, in English. Judgment on the award may be entered in any court of competent jurisdiction. Class action waiver: disputes will be brought only in your individual capacity, not as a plaintiff or class member in any purported class, consolidated or representative proceeding. If the class action waiver is found unenforceable as to a particular claim, that claim proceeds in court.
Exceptions. Either party may bring an individual claim in small claims court in Los Angeles County, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorized access. For any claim not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California. Nothing here waives mandatory consumer protections available to you where you reside.
13. General
You agree to indemnify and hold us harmless from claims and costs arising out of your misuse of the site or breach of these Terms. If any provision is unenforceable, it is severed and the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale of assets. These Terms, with the policies referenced in section 1, are the entire agreement between us.
We may update these Terms; the effective date at the top of this page shows the current version, and continued use after that date is acceptance. Questions: hello@guesswhatcountry.com.
